Law and disorder: Big Daddy slips

July 18, 2009|By Veronica Rocha

Michael J. Greenberg, Michael Greenberg Jr. and Big Daddy Racing v. California Department of Transportation, et al., Case No. EC050105

Slick roads may often lead to traffic accidents, so claims Michael J. Greenberg.

He claimed he would have avoided an April 12, 2008, accident if a construction zone on the Foothill (210) Freeway wasn’t slicked with oil , according to a lawsuit filed in Burbank Superior Court.

On that fateful day, construction crews were resurfacing the freeway near Foothill Boulevard when a wet substance leaked onto about a mile of roadway, the suit stated, causing Greenberg to crash.

Once the substance came into contact with the truck’s tires, he skid out of control and struck a semi-truck, catching fire, according to the lawsuit.

Greenberg claims the California Department of Transportation “owed a duty to the plaintiff and to the public to maintain the safety and travel-worthiness of the 210 Freeway.”

He further claimed that Caltrans failed to warn the public about the road work and didn’t have adequate traffic control.

He is seeking $155,559 in damages.

Insurance trap

State Farm Mutual Automobile v. Gegam Khachatryan, Vrezh Topalian, Mourad Topalian, et al., Case No. EC049965

Something didn’t seem right about an accident that Gegam Khachatryan, a Glendale resident, tried to claim with State Farm Insurance.

He told insurance representatives that he was driving about 7 p.m. on Nov. 27, 2007, on the Golden State (5) Freeway to his favorite supermarket in Sunland before it closed at 8 p.m. The market, however, closed at 7 p.m.

Khachatryan’s car started to leak anti-freeze fluid, so he pulled over and called an unnamed friend for help. But his story smelled of something stronger than anti-freeze, so says a lawsuit filed in Burbank Superior Court.

Khachatryan was driving a 2003 Nissan Altima on the I-5 Penrose Street off-ramp when he dropped a lit cigarette and rear-ended a vehicle in front of him, the lawsuit stated.

The company claims that Khachatryan’s friend has been reported twice on suspicion of insurance fraud.

Khachatryan, State Farm complains, hasn’t cooperated. The company is suing for more than $10,000 and the right to not provide coverage.

Road rage

Diana Asatryan v. Hovhannes Dermenjian, Simon Galustian, Arman Nazaryan and Garen Hakopian, Case No. EC050257

A joyous night for Diana Asatryan and her family turned into a random attack on the Foothill (210) Freeway.

Asatryan, her husband and two sons left a wedding on Sept. 1, 2007, and headed home. Before Asatryan could drive onto the freeway’s on-ramp at Lowell Avenue, Hovhannes Dermenjian, Simon Galustian, Arman Nazaryan and Garen Hakopian blocked her car.

The foursome got out of their vehicle went up to Asatryan’s car, began hitting her husband and son, and then fled.

Asatryan did not say in a lawsuit filed in Glendale Superior Court whether her family knew the men. Her husband suffered a broken nose and needed surgery.

Her son couldn’t walk for a month. She is seeking more than $10,000 in damages.
